I left my husband a year ago.  He remained in the hosue we own-well we dont own it, but a mortgage and a 2nd mortgage.  He moved his brothers family in this past May to help fix up things, repair things, and hopefully sell it.  They all have been living in this house since May and have not once paid the mortgages.  About three weeks ago, I received acertified letter stating that the home will be foreclosed and sold on the court house stairs of the clay county courthouse-the next morning!  So, what I need to know is this:

I have not received any notification of who bought it. 

Will I be notified?

How much time will I have to get all my stuff still remaining in the house, out?

What legal ramifications will I be held responsible for since I have moved out a year ago?

If I file bankruptsy-which I eventually will in my name,  can this debt be included?

Yes, I am pissed that X did not follow thru with his plans to fix up and sell it as he told me he was going to do.

No I dont care a damn thing for the house as it should be condemned by the city since it is there fault thjat the city sewer backs up in our family room everytime it rains! No one will ever be able to live or want to live in this dump.

I don't believe you will be notified of who bought the house.

If your name is on the mortgage loan, you will be held responsible for any shortfall- what is left on the mortgate minus what they sold it for. It doesn't make any difference whether you were living there or not. Whether you can claim this in bancruptcy, you will need to talk with a lawyer about.

You might want to get with the county clerk office to see how long you have to get your stuff out....if it is still there.

After the sell is complete, you will be a able to look it up in the county tax records and see who owns it, and what they paid, that is public record.

Normally after 3 missed payments, the bank has the right to evict, but they have to atleast put your belongings in no less than plastic bags, and then they will put them on the curb, they only have to protect them from weather, the way the law in Missouri states, your belongings are trespassing on their property so they have the right to remove them,

I agree with Meancat. Too bad your husband didn't refinance the house after the divorce and get your name off of it, then you wouldn't have been involved. If it has already been sold, you'd better go there and try to see if you can get the stuff out this weekend. I wouldn't wait. They might have already changed the locks.

Hmmm, well I am recently separated after 27 years. It is a good thing though! I have two kids, 16 & 21 and a 2 yr old granddaughter. I have lived north of the river since 1974. Would never live any other place. Depending what time of the year it is, is what I do for a living. I used to work for HR Block managin an office for 10 years, but they suck so I quit plus I am better than they are so there. During the political season, I help Sam Graves campaign or whomever needs my help! My fulltime job right now along with whatever else I am doing, is managing a small kiosk up at KCI airport. We sell a portable scanner that scans receipts, business cards & documents so you can do your expenses! I love the airport! As my name states, I am a nader chaser- not ralph nader, tornader! I love severe weather! I have the Infamous May 4th tornado on video! I absolutely love to BLOG! I listen to talk radio in my car ALL the time!I love to go to garage sales, I love politics and I love reality TV! My life right now is very exciting and I love it!
